We thank you for visiting our Website, and would like to take the opportunity to inform you that the access and use of the Website activities are regulated by these Terms and Conditions of Sales. The access and use of this Website, as well as the purchase of products, imply the reading, knowledge and acceptance of these Conditions of Sales.

Mat Jewels is a trading name represented by sole proprietorship enterprise with VAT number 12264170965, registered in Via Grigna 1, Milan 20155, Italy. Mat.Jewels is the subject who sells the products and provides the services (the “Seller”).

These Terms and Conditions of Sales owned and managed by Mat.Jewels, Sole proprietorship enterprise 12264170965 ("Mat.Jewels" or, alternatively, the "Seller"), are included in the present contract of sale ("Contract") and regulate the sales of Mat Jewels products (“Products”) and services within the European Union through the website www.matjewels.com (the “Website”) or via our Customer Service Centre by telephone, WhatsApp and/or e-mail, and with the Website, all “Sales Channels”.

Every user visiting the Website ("User", or "Customer") is invited to read carefully The Terms and Conditions before completing an order for purchase of Products on the Website ("Order"). The purchase of Products on this Website implies the acceptance of these Terms and Conditions of Sale.

Any modification or amendment to these Terms and Conditions of Sale will immediately become effective after being published on this Website and will regulate all the orders and subsequent sales of Products or services.

  1. Purchase

In order to make purchases on the Website you will be required to provide your personal details. In particular, you must provide your real name, phone number, e-mail address and other requested information as indicated. Furthermore, you will be required to provide payment details that you represent and warrant are both valid and correct and you confirm that you are the person referred to in the Billing information provided.

The Website is available only to individuals and others who meet the Mat.Jewels terms of eligibility, who have been issued a valid credit/debit card by a bank acceptable to Mat.Jewels, whose applications are acceptable to Mat.Jewels, and who have authorized Mat.Jewels to process a charge or charges on their credit/debit card in the amount of the total purchase price for the products which they purchase. Only natural persons who (a) have reached the legal age of majority (eighteen in most states); (b) have the legal capacity to enter into contracts; (c) are consumers, i.e., acting for purposes unrelated to any entrepreneurial, commercial, craft or professional activity they may carry out, are considered “Eligible Persons” who can complete orders for products through the Website. By placing an order through the Website, the Customer expressly declares and guarantees that they meet all the aforementioned requirements, including, but not limited to, being a bona fide end customer, who is purchasing products or services for exclusively personal use from the Seller who, should any of these requirements fail to be met, will enforce their rights in the appropriate places.

Products purchased by the Customer are for personal or gift use and should not be re-sold, used for commercial purposes or any other commercial benefit. 

By making an offer to purchase products you expressly authorize us to perform credit checks and where Mat.Jewels feels necessary, to transmit or to obtain information (including any updated information) about you to or from third parties, including but not limited to your credit/debit card number or credit reports (including credit reports for your spouse if you reside in a community property jurisdiction), to authenticate your identity, to validate your credit/debit card, to obtain an initial credit/debit card authorization and to authorize individual purchase transactions.

Furthermore, you agree that we may use Personal Information provided by you in order to conduct appropriate anti fraud checks. Personal Information that you provide may be disclosed to a credit reference or fraud prevention agency, which may keep a record of that information.

Please refer to our Privacy Policy for further information about how we use your data. 

  1. Orders

All Orders are subject to acceptance and availability. Once the Order has been placed, you will receive an email confirming the details of your Order. The relevant Contract should be considered finalized at the time of receipt of the Order confirmation on the part of the Customer.

Before that time, the Seller reserves the right to refuse acceptance of an Order at its discretion. In particular, we are not be responsible, in any way, in the event that a Product that has been ordered is removed from the Website following the submission of the relevant Order. It may in fact occur that the Website erroneously displays Products that are not available at that time.

In the case of total unavailability of the Order, however, the Customer Service will contact the Customer in order to inform the Customer that the Order will not be processed, and will cancel the relevant Order. In such case, no charge will be imposed in relation to the Customer.

During Checkout process, the Customer is invited to check, identify and correct any errors in data input and/or processing of the data supplied in order to confirm correctly the details of the order, personal information including e-mail, shipping address, billing address and payment information).

The Seller reserves the right to refuse, cancel and/or modify, for justified reasons, an order, at any time prior to payment. By way of example, but not limited to the following, it is our option to refuse, modify or cancel the order if the Customer does not provide sufficient solvency guarantees, if the order is incomplete or incorrect, if the product is no longer available, in case of a dispute concerning the payment of a previous order, in case of suspicion, at the sole discretion of the Seller, or that the Customer might have undertaken fraudulent activities; or might have infringed these Terms and Conditions of Sales in any way. 

The Sale Contract is concluded in Milan, Italy.

  1. Payments

We accept the payment methods as indicated during the order process and available on the Website. Depending on the payment mode, further information may be required, including specific forms of identification.

The Seller will proceed to charge the price of the purchase, as defined below ("Price"). However, prior to the acceptance of the Order, security checks may be carried out regarding the Payment method chosen by the Customer for the Order, or a pre-authorization or a pre-charge for the sake of caution.

The Seller reserves the right to cancel a transaction and the relevant Order in the event that it appears that fraudulent use is being made of the Payment method adopted for the Order. Moreover, the Seller and the Website will not be responsible in the event that illegal use is made of a Payment method by third parties which is not connected to any error or negligence by the Website or the Seller.

  1. Shipping and delivery

The Orders are dispatched and delivered by DHL courier from Milan, Italy.
Mat.Jewels commits itself to deliver the Orders to Customers in a precise and timely manner, in conformity with the terms of delivery shown on the Website and, in every case, within 30 (thirty) days from the date of notification of the Shipment confirmation to the Customer.
The Shipment Confirmation is usually sent to the Customer at the time the Products are dispatched to the courier for delivery. In certain circumstances, such as, for example, festive periods, delivery times may vary. The Seller shall not be held responsible for delays in delivery that are not connected to its fault or negligence. To this extent, the Seller shall be exempt from responsibility for delays due to force majeure, strikes, natural disasters, occurrences related to customs procedures, and any other occurrence relating to the provision of delivery services or any other circumstance outside its control.
Customers are encouraged to do everything in their power to facilitate the delivery of the Order, making themselves available for receipt or delegating to a third party.
The courier will make a first attempt at delivery of the Order at the address indicated by the Customer. Where the outcome of the delivery is negative, the courier will inform the Customer of the attempt at delivery and will try to arrange a subsequent delivery of the Order with the Customer.

In the event that the courier is definitively unable to deliver the Order, Customer Service will contact the Customer in order to resolve the situation.

At the time of delivery, the Customer must verify the exactness of the number of the parcels and the integrity of the external packaging. In the event that the Customer finds anomalies with the delivery, for example regarding the number of parcels or damage to the external packaging, the Customer must conditionally sign the delivery document and contact the Customer Service. In the event that the Customer fails to do so, the Customer will not be able to bring a claim in relation to the delivery, save for as provided under article 8 below in relation to hidden faults and in respect of any applicable consumer protection law.

  1. Prices, Taxes and Shipping Costs

For customers who connect to the Website from the European Union, the prices shown are inclusive of VAT, unless otherwise indicated, and exclusive of any shipping costs and other taxes. For customers who connect to the Website from any country outside the European Union, the prices shown are exclusive of VAT, any shipping costs and other taxes. The Seller reserves the right to charge shipping costs to the Customer, depending on the sales policies in place at the time of the order, which are established at the discretion of the Seller. These expenses will be clearly displayed and/or communicated during the order process. Where not specified, these expenses will not be applied. These total expenses will be displayed before confirmation and completion of the order and will also be shown in the subsequent order summary sent to the Customer. The Seller is entitled to change prices and delivery costs at any time and without notice, it being understood that the shipping costs are those displayed at the time of ordering, as clearly indicated during the order process. The Seller undertakes to ensure that product prices and delivery costs are correct at the time the information is entered into the system. In the event that, despite our reasonable efforts, some prices or delivery costs are calculated incorrectly, the Customer will be contacted as soon as possible and can choose whether to confirm an updated order with the new prices or delivery costs or cancel the order; only in the event that the Seller is unable to contact the Customer using the contact details provided during the order process will the Seller cancel the order and refund the amount paid.

If you are a customer whose credit/debit card is not denominated in EUR (Euros), the final price will be calculated in accordance with the applicable exchange rate on the day your card issuer processes the transaction.

Regardless of your shopping destination and the currency you shop in, your purchase may be processed by one of our regional affiliate companies in which case your bank may charge you an international transaction fee. Mat.Jewels is not responsible for any such fee or charge.

  1. Vouchers and discount coupons

During marketing campaigns, Mat.Jewels may issue vouchers and discount coupons for purchase use on this Website. Vouchers and discount coupons cannot be refunded.

  1. Guarantee

Subject to the provisions set out in article 4 above, Mat.Jewels assumes responsibility for every defect in the Products. We guarantee the Customer that Products sold are not defective and that they conform to what has been set out in the Contract, that is, in particular, that the Products:

  • Conform to the description provided on the Website and possess the qualities of the Products that the Seller has presented to the Customer as a model on this Website;
  • Possess the usual qualities and characteristics of products of the same kind, and that the Customer can reasonably expect, taking into account the nature of the product.

For technical reasons, neither Mat.Jewels, nor the Website can guarantee that the visualization of the colors on the screen will always be accurate.
Marginal differences between the description of the Product on the Website and the actual characteristics of the Product will not be considered cause for non-compliance of the Product for the purposes of the present Contract. 

Upon receipt of the product(s), the Customer must inspect them to check for any defects. Should the Customer find a defect, they must notify the Seller as soon as possible. Legislative Decree No. 206/2005 (known as the Consumer Code) provides a legal guarantee for defective products, under which Mat.Jewels is liable to the Customer, as a consumer, for any defects that occur within two years of delivery of the goods. In summary, Legislative Decree No. 206/2005 provides, in the event of a product defect, for (i), the right of the Customer to receive, at their choice and at no extra cost, replacement or repair of the product unless one option is objectively impossible or excessively expensive compared to the other; (ii) the right of the Customer to receive, at their choice, a reduction in price or termination of the contract, not applicable to minor defects, in the event that repair and replacement are objectively impossible or excessively expensive or should the Seller fail to repair or replace the product within a reasonable time or a previous replacement or repair has caused excessive inconvenience to the Customer. Any complaint regarding defective products must be made within two months of discovery and any action taken regarding any defects not intentionally concealed by the Seller must occur, in any case, within twenty-six months from delivery of the product. As a consumer, the Customer may be entitled to other rights granted by mandatory laws, which remain unaffected by these General Conditions of Sale.

9. Exchange and return of Products

The Customer has the right to cancel the Order within 14 days without giving any reason. The cancellation period will expire 14 days from the day after the day on which you or delegated from you person receives the Order. To exercise the right to cancel you must inform us by email to info@matjewels.com

You may prefer to return or exchange items. In this case you must request your exchange or return and send your items back to us within 28 days for a refund of the value of the item only, or an exchange of the item. 

Shipping is complementary, and exchanges made to destinations outside the EU will be processed for customs clearance and therefore any relevant import duty and tax charges will apply.

For any will the Customer must contact Mat.Jewels via email to notify on intentions. The Customer should kindly refer to the unique identifying number for the Order, as set out in the Order Confirmation.

The possibility of return Products is available only in relation to Orders that have already been delivered to the Customer based on the tracking system provided by the courier.

The return or exchange form will be pre-filled out by the Seller; the Customer must verify the accuracy of the facts stated therein and, moreover, check that the notice bears the unique identifying number for the Order and, if any, the request to exchange the Product with a similar unit of the Product in a different color.

After receipt of the form, the Seller will confirm receipt of the form to the Customer via email. For the return, the Customer will be able exclusively to contact the courier indicated by the Seller in order to arrange the return of the Products and must attach the delivery tag provided by Seller via email on the relevant parcel.

The Customer must without fail deliver the Products to the courier for the return to the Seller within 14 (fourteen) days. In particular:

  • The returned Products should be sent back with all labels, safety tags, packaging and accessories (cases, boxes, etc.) that came with the Order;
  • The Products, labels, safety tags, packaging and accessories should not show any sign of usage, or scratches, or have been changed in any way and should be sent back in the same condition in which they were sent out by the Seller and in their original internal packaging “Mat.Jewels”.

However, the purchase Cost will not be refunded in relation to:

  • Products that have had their security tags removed or cut off; and/or
  • Products that have been used, are incomplete (in particular where there are missing parts or accessories), ruined, damaged, in a state of deterioration or dirty.
  •  Products returned without their internal packaging.

The Customer will be considered liable for any diminished value of the Products resulting from all manipulation other than that necessary to establish the nature, characteristics and functioning of the Products.

Once the prerequisites for exchange of the Product or for Return have been verified, the Seller will communicate to the Customer its acceptance of the return and will proceed to the replacement of the Product or, in the case of Return, to the refund.

The Seller agrees to start Refund procedure described above within 14 (fourteen) days from the date of receipt of the returned Products. Reimbursement will be effected via the same Payment method used by the Customer for the Order.

In the event that the Customer has returned the Products without complying with the prerequisites for Return, the Seller will not be able to recognize any right of return. In such case, the Seller will return the Product to the Customer, having previously confirmed his or her availability in this regard, reserving the right to charge any subsequent delivery costs to the same.

Customers should dispatch the Products for return from the same country where the Products were first delivered.

  1. Applicable Law and Resolution of Disputes

The Contract and the present Terms and Conditions of Sales shall be governed by and interpreted in accordance with the laws of the country in which the Seller’s registered office is, therefore, the Italian law, without reference to the provisions on the conflict between laws and with the express exclusion of the application of the United Nations’ Convention on the International Sale of Goods. In any areas where applicable laws were different from the laws of application required to protect consumers in the Customer’s country of residence, we will offer similar protection.

Any disputes or disagreements based on the sale contract, including those on, or in relation to, the Terms and Conditions of Sales, including the validity, invalidity, breach or termination of the sale contract, shall be judged or arbitered in accordance with this Section.

If the Customer considers that there is a problem related to the purchase of products, the Customer may lodge a complaint with Mat.Jewels, by sending it to the contact details indicated in Article 19.

The Customer and the Seller agree to commit to strive to work together for a period of thirty (30) days to settle in a friendly manner, any dispute or disagreement arising, directly or indirectly, from the products or services, from the Terms and Conditions of Sales, or any breach or violation of such elements.

In case it is not possible to resolve the dispute when examining the complaint, Mat.Jewels, pursuant to Article 141 sexies terzo comma D. Lgs. 205/2006, shall inform the Customer about the ADR– Alternative Dispute Resolution – entity or entities competent in this matter, specifying whether it intends to use the aforementioned bodies for the resolution of the dispute.

Mat.Jewels informs the Customer that, as a consumer, the European Union has established an online platform for dispute settlements related to the online purchase of products or services. The platform, called ODR, is managed by the European Commission and can be reached at the following link https://webgate.ec.europa.eu/odr. Through the platform, the Customer can consult the list of ADR entities and activate an online dispute resolution procedure.

The use and eventual effectiveness of the above instruments does not exclude the Customer’s right to make a claim for his or her rights before the competent judicial authority. If the Customer’s residence or domicile is located in Italy, the jurisdiction of the individual is to be held in the courts of the place where the Customer is a resident or is domiciled. The Customer whose residence or domicile is in a European Union State other than Italy, can make his or her claims against Mat.Jewels, before the courts of the Member State in which he or she is domiciled or is a resident of, or before the Italian courts, that being the country in which the registered office of Mat.Jewels is located. 

  1. Communications and complaints

For every communication, notification or complaint relating to an Order and to the application of these Terms and Conditions of Sale, the Customer will be able to contact the Customer Service via email info@matjewels.com 

  1. Intellectual property rights

Your use of the Website and its contents grants no rights to you in relation to any copyright, designs, trademarks and all other intellectual property and material rights relating to the Content (as described in the Content section below), including Mat.Jewels. Software and all HTML and other code contained in this Website. All such Content including third party trademarks, designs, and related intellectual property rights mentioned or displayed on this Website are protected by national intellectual property and other laws and international treaty provisions. You are permitted to use the Content only as expressly authorized by Mat.Jewels. and/or its third party licensors. Any reproduction or redistribution of the above listed Content is prohibited and may result in civil and criminal penalties. Without limiting the foregoing, copying and use of the above listed materials to any other server, location or support for publication, reproduction or distribution is expressly prohibited. 

  1. Content

In addition to the Intellectual property rights mentioned above, "Content" is defined as any graphics, photographs, including all image rights, sounds, music, video, audio or text on this Website. Mat.Jewels tries to ensure that the information on this website is accurate and complete, but may occur to present some errors.

  1. Limitation of Liability

To the maximum extent permitted by applicable laws, the Seller rejects and excludes any other term, condition, and guarantee, whether expressed or implied, in relation to its products, services, or Sales Channels.

No provision of these General Sales Terms intends to limit or exclude our liability any further than it might be limited or excluded by applicable laws. Without prejudice to the previous sentence, the contractual, non-contractual or other nature of liability of the Seller versus the Customer may in no event exceed the total amount paid by the Customer for the applicable order. The Seller also declines any liability for any default or delay in fulfilling its obligations under these General Sales Terms, should such problems be due to causes outside its control.
